Tratado Preliminar de Amizade e Comercio Entre A Republica Portuguesa e A Republica da China. Assinado em Nankim em 19 de Dezembro de 1928

[ 1 ] O TRATADO A Republica Portuguesa e a Republica da China, egual- mente animadas do desejo de estreitar os vínculos de amizade que ha mais de quatro séculos felizmente subsistem entre os dois Paizes, resolveram concluir um Tratado Preliminar de Amizade e Comercio, e para este fim nomearam os seus Pleni- potenciários, a saber: Sua Excellencia o Presidente da Republica Portuguesa: o Senhor João Antonio de Bianchi, Gran-Cruz da Ordem de Cristo de Portugal, Oficial da Ordem de S. Tiago da Espada, Gran-Cruz da Espiga do Ouro, etc., etc., Enviado Extraordinário e Ministro Pleni- potenciário da Republica Portuguesa na China; Sua Excelência o Presidente do Governo Nacional da Republica da China: o Doutor Chengting T. Wang, Ministro dos Negocios Estrangeiros do Governo Nacional da Republica da China; os quais, depois de haverem trocado os seus respectivos plenos poderes, que acharam em boa e devida forma, con- cordaram nos seguintes Artigos:—

[ 2 ] ARTIGO I As duas Altas Partes Contractantes concordam que as tarifas aduaneiras e todas as questões que com esttas se relacionam serão reguladas exclusivamente pelas respectivas legislações nacionais. Mais convencionam que cada uma das Altas Partes Con- tractantes gosará nos territórios da outra Parte, pelo que se refere ás questões aduaneiras ou àquelas que com estas se relacionam tratamento que não seja por qualquer forma menos favorável do que o tratamento concedido a qualquer outro paiz. Os nacionais de cada uma das duas Altas Partes Contrac- tantes não serão obrigados, sob qualquer pretexto, a pagar, a dentro dos territórios da outra Parte, quaisquer direitos, im- postos internos ou taxas sobre a importação e exportação de mercadorias, diversos ou mais elevados do que aqueles que são pagos pelos nacionais do proprio paiz ou pelos nacionais de qualquer outro paiz, ARTIGO II Os nacionais de cada uma das duas Altas Partes Con- tractentes ficarão sujeitos, no território da outra Parte, ás leis a jurisdicção dos tribunais dessa Parte, aos quais terão livre e fácil acesso para a garantia de execução e defeza dos seus direitos. ARTIGO III As duas Altas Partes Contractantes resolvem entabolar, o mais cedo possível, negociações com o fim de concluir um Tratado de Comercio e Navegação baseado nos princípios de absooluta egualdade e não discriminação nas suas relações comerciais, e de mútuo respeito pelos direitos de soberania.

t 3 ] ARTIGO IV Do presente tratado se fizeram duas copias em cada uma das línguas portuguesa, chinesa e inglesa. No caso de haver divergência na interpretarão, servirá o texto inglês para de- cidir as duvidas que se suscitarem. ARTIGO V O presente tratado será ratificado com a maior brevidade possível e entrará em vigor no dia em que os dois governos notificarem um ao outro que a ratificação se efectuou. Em fé do que, os respectivos Plenipotenciários assinaram o presente tratado e afixaram os seus sêlos. Feito em Nankim, aos dezanove dias do mês de Dezembro de 'mil novecentos e vinte e oito, que corresponde ao decimo nono dia do decimo segundo mês do decimo sétimo Ano da Republica da China. [ 5 ] ANEXO I Nankim, 19 de Dezembro de 1929 Senhor Ministro, Em nome do Governo Nacional da Republica da China, tenho a honra de declarar que fica entendido que o Artigo II do Tratado hoje assinado entre a China e Portugal só começará a vigorar no dia 1 de Janeiro de 1930. Antes dessa data, o Governo Chinês fará arranjos detalhados com o Governo Português para que a China assuma jurisdicção sobre os cidadãos portugueses em território chinês. Na falta de tais arranjos na referida data, os cidadãos portugueses ficarão sujeitos ás leis e jurisdicção chinesas a partir de uma da*a a fixar pela China apóz acordo para a abolição da exterritori- alidade com todas as Potencias signatárias dos Tratados de Washington, ficando entendido que tal data será aplicável a todas essas mesmas Potencias. Por ' Potencias signatárias dos Tratados de Washington" entender-se-ha todas as Potencias, com excepção da China, que directamente participaram na discussão das questões do Pacifico e do Extremo Oriente na Conferencia sobre Limitação de Armamentos realisada em Washington em 1921-22. Aproveito esta ocasião para reiterar a Vossa Excelência os protestos da minha mais alta consideração. CHENGTING T. WANG. Senhor Ministro, Tenho a honra de acusar recepção da nota de Vossa Excelência, datada de hoje, como segue:— "Em nome do Governo Nacional da Republica da China, tenho a honra de declarar que fica entendido que o Artigo II do Tratado hoje assinado entre a China e Portugal só começará a vigorar no dia 1 de Janeiro de 1930. Antes dessa data, o Governo Chinês fará arranjos detalhados com o Governo Português para que a China assuma jurisdicção sobre os cidadãos portugueses em território chinês. Na falta de tais arranjos na referida data, os cidadãos portugueses ficarão sujeitos ás leis e jurisdicção chinesas a partir de uma data a fixar pela China após acordo para a abolição da exterritoriali Jade com todas as Potencias signatárias dos Tratados de Washington, ficando entendido que tal data será aplicável a todas essas mesmas Potencias. C 7 ] ANEXO II DECLARAÇÃO Tenho a honra de declarar que no dia 1 de Janeiro de 1930 ou antes dessa data, o Governo Nacional da Republica da China promulgará o Codigo Civil e o Codigo Comercial em aditamento aos outros codigos e leis actualmente em vigor. CHENGTING T. WANG. ANEXO III DECLARAÇÃO Em nome do Governo Nacional da Republica da China, tenho a honra de declarar que, quando os cidadãos portugueses deixarem do gosar dos privilégios da jurisdicção consular e doutros privilégios especiais, e quando as relações entre os dois paizes estiverem em pé de perfeita egualdade, o Governo Chinês, atendendo a que os cidadãos chineses gosam, sujeito ás restriecues impostas pelas leis e regulamentos portugueses, do direito de residir e comerciar e adquirir propriedade em qualquer parte do território português, concederá esses mesmos direitos aos cidadãos portugueses na China, sujeitos ás restricçCes que sejam prescriptas nas leis a regulamentos chineses. [ 8 ] ANEXO IV DECLARAÇÃO CONJUNTA Fica entendido que os cidadãos portugueses em territórios chineses e cidadãos chineses em territórios portugueses pagarão de futuro as contribuições e impostos que pres- creverem os regulamentos e leis devidamente promulgadas pelos Governos Chinês e Português, respectivamente, contanto que essas contribuições ou impostos não sejam diversos ou mais elevados do que as contribuições e impostos pagos pelos nacionais de qualquer outro paiz. Senhor Ministro, Com referencia ao Artigo I do Tratado por nós assinado hoje, tenho a honra de rogar a Vossa Excelência se digne con- firmar se é exacta a minha interpretação do referido Artigo como abrangendo o principio seguinte: Os artigos produzidos ou manufacturados no território de uma das Altas Partes Contractantes, ao serem importados em território da outra Parte ou ao serem exportados do seu proprio território para o território da outra Parte, não ficarão sujeitos a quaisquer direitos, impostos internos ou taxas diversas ou mais elevadas do que as cobradas, respectiva- mente, sobre artigos semelhantes produzidos ou manufactu- rados em qualquer outro paiz ou de qualquer outro paiz im- portados, ou sobre artigos semelhantes produzidos ou manu- facturados no proprio paiz e para qualquer outro paiz ex- portados. Senhor Ministro, Com referencia ao Tratado por nós assinado hoje e aos Anexos ao mesmo, tenho a honra de declarar que interpreto a palavra território" ou "territórios" empregada no referido Tratado bem como nas Declarações e Notas trocadas como compreendendo as possessões e colonias de cada uma das Altas Partes Contractantes. Muito agradeceria se Vossa Excelência se dignasse con- firmar a exactidão da referida interpretação. Aproveito esta oportunidade para reiterar a Vossa Exce- lência os protestos da minha mais alta consideração. CHENGTING T. WANG. [ 15 ] THE TREATY The Republic of Portugal and the Republic of China, being equally animated by the desire to strengthen the ties of friendship which have happily subsisted between the two coun- tries for more than four hundred years and to promote and consolidate their commercial relations, have resolved to con- clude a Preliminary Treaty of Amity and Commerce, and have, for this purpose, named as their Plenipotentiaries, that is to say: His Excellency the President of the Republic of Port.1 gal: Mr. João Antonio de Bianchi, Grand Gross of the Order of Christ, Officer of the Order of S. Tiago de Espada and Grand Gross of Chia Ho, Envoy Ex- traordinary and Minister Plenipotentiary of the Republic of Portugal to China; His Excellency the President of the National Government of the Republic of China: Dr. Chengting T. Wang, Minister for Foreign Affairs of the National Government of the Republic of China: Who, having met and communicated to each other their respective full powers, found in good and due form, have agreed upon the following Articles:

t 16 ] ARTICLE I The two High Contracting Parties agree that the customs tariff and all matters related thereto shall be regulated exclusively by their respective national legislations. It is further agreed that each of the High Contracting Parties shall enjoy in the territories of the other, with respect to customs and all related matters, treatment in no way less favourable than the treatment accorded to any other country. The nationals of each of the two High Contracting Parties shall not be compelled, under any pretext whatever, to pay within the territories of the other Party any duties, internal charges or taxes upon the importation or exporta- tion of merchandise, higher or other than those paid by the nationals of the country or by the nationals of any other country. ARTICLE II The nationals of each of the two High Contracting Parties shall be subject, in the territories of the other Party, to the laws and jurisdiction of the law courts of that Party, to which they shall have free and easy access for the enforce- ment and defence of their rights, ARTICLE III The two High Contracting Parties have decided to enter as soon as possible into negotiations for the purpose of con- cluding a Treaty of Commerce and Navigation based on the piinciples of absolute equality and non-discrimination in their commercial relations and mutual respect for sove- reignty.

[ 17 ] ARTICLE IV The present Treaty has been drawn up in two copies in Portuguese, Chinese, and English. In case of any difference of interpretation, the English text shall be held to prevail. ARTICLE V The present Treaty shall be ratified as soon as possible and shall come into force on the day on which the two Governments shall have notified each other that the ratifica- tion has been effected. In faith whereof, the respective Plenipotentiaries have signed the present Treaty and have affixed thereunto their seals. Done at Nanking this nineteenth day of December, nine- teen hundred and twenty eight, corresponding to the nine- teenth day of the twelfth month of the seventeenth year of the Republic of China. [ 19 ] ANNEX I Ministry of Foreign Affairs Nanking, December 19, 1928. Monsieur le Ministre, In the name of the National Government of the Re- public of China, I have the honour to state that Article II of the Treaty signed this day between China and Portugal shall be understood to begin to be operative on January 1st, 1930. Before such date the Chinese Government will make detailed arrangements with the Portuguese Government, for the as- sumption by China of jurisdiction over Portuguese subjects in Chinese territory. Failing such arrangements on said date, Portuguese subjects shall be amenable to Chinese laws and jurisdiction from a date to be fixed by China, after having come to an agreement for the abolition of extraterritoriality with all the Powers signatory of the Washington Treaties, it being understood that such a date shall be applicable to all such Powers. By "Powers signatory of Washington Treaties" shall be meant those Powers, other than China, which directly partici- pated in the discussion of Pacific and Far Eastern Questions in the Conference on the Limitation of Armament held in Washington in 1921-22. [ 21 ] ANNEX II DECLARATION I have the honour to declare that on or before January 1st, 1930, the Civil Code and the Commercial Code, in addi- tion to other codes and laws now in force, will be duly pro- mulgated by the National Government of the Republic of China. ANNEX III DECLARATION In the name of the National Government of the Republic of China, I have the honour to declare that, when Portuguese subjects cease to enjoy the privileges of consular jurisdiction and other special privileges, and when the relations between the two countries are on a footing of perfect equality, the Chinese Government, in view of the fact that Chinese citizens, subject to the limitations prescribed in Portuguese laws and íegulations, enjoy the right to live and trade and to acquire property in any part of the Portuguese territory, will grant the same rights to Portuguese subjects in China, subject to the limitations to be prescribed in its laws and regulations. ANNEX IV JOINT DECLARATION It is understood that Portuguese subjects in Chinese terri- tories and Chinese citizens in Portuguese territories shall here- after pay such taxes or imposts as may be prescribed in the laws and regulations duly promulgated by the Chinese and the Portuguese Government, respectively, provided that such taxes or imposts are not other or higher than those paid by the nationals of any other country. Monsieur le Ministre, With reference to Article I of the Treaty signed between us this day, I have the honour to request Your Excellency to confirm my understanding that the said Article shall be interpreted to include the following principle: Articles produced or manufactured in the territory of either of the High Contracting Parties shall not be subject on their importation into the territory of the other Party or on their exportation from its own territory to the territory of the other Party, to any duties, internal charges or taxes other or higher than those paid respectively on like articles produced or manufactured in and imported from any other country or on like articles produced or manufactured in the country and exported to any other country.
